1. About these terms
These terms govern your use of Upland, a website for finding property for sale and land available on annual leases in Kenya, and for connecting with the agents, estate agencies, buyer advocates, and law firms who handle them. By creating an account, or by using Upland after a new version of these terms takes effect, you agree to them. If you do not agree, do not use Upland. How we handle personal data is explained in our Privacy Policy.
2. What we do — and what we don't
Upland publishes listings from property professionals, lets people contact them, make offers, and request to buy or lease, and records the steps of a transaction. We are not a party to any sale or lease, we do not own or sell property, and we do not collect, hold, or pass on payments for property.
Before a listing goes live we check a narrow set of facts: that the lister says they are authorized by the owner and supplied the evidence we ask for, and that an official search record was provided or obtained. We do not confirm title, survey, valuation, planning, or legal safety, and a verified badge is not legal advice or a guarantee. Before you commit to a purchase or lease, your own advocate should carry out a fresh, independent search and due diligence.
A listing shows an approximate area, within about a kilometre, rather than the exact location. The lister decides when and how to share the exact location.
3. Your account
- You must be at least 18 and able to enter into a binding agreement.
- Give accurate information, keep it up to date, and use one account for yourself.
- Keep your password secret. You are responsible for activity on your account.
- Professional accounts must describe your role truthfully. An agency or law firm may be created only by someone entitled to act for it.
4. Listing property
If you list a property, you confirm that:
- you own it or have the owner's current authority to market it;
- the details, photos, prices, and availability are accurate and kept current;
- the documents you upload are genuine and yours to share with us, and with a buyer whose request you accept and that buyer's advocate; and
- you will withdraw or update the listing promptly when your authority ends or the property is no longer available.
Every listing is reviewed before publication, and a material change sends it back for review. We may decline, hold, or remove a listing that appears inaccurate, unauthorized, or unsafe. You keep ownership of your content and give us a licence to host, display, and adapt it (for example, resizing photos) to run Upland.
5. Offers, requests, and transactions
Offers and requests to buy or lease are between the buyer or leaseholder and the seller. Accepting a request reserves the listed unit or plot for the stated period so that the buyer's advocate can carry out due diligence, and lets the buyer and their advocate open the listing's mandate, title copy, search certificate, and the registered owner's contact details for that purpose only. Upland records the progress you and the other participants enter; the legal completion happens outside Upland, under your own agreements and advice.
An advocate's fees and terms of engagement are agreed and paid directly between the client and the advocate or their firm. Upland does not set, collect, or take a share of legal fees and is not a party to that engagement.
We strongly recommend an independent advocate. A buyer or leaseholder may instead choose to carry out due diligence themselves after acknowledging the risks shown at that step. If you do, the checks and their consequences are your responsibility; Upland does not review your work.
6. Reviews and reports
Only the buyer or leaseholder on a completed, recorded transaction may review the professionals and organizations who served that transaction, once each. Reviews must be honest and about your own experience. Reports of scams, false listings, or abuse are private and reviewed by our team.
7. Things you must not do
- Post false, misleading, or unauthorized listings, or ask for payment outside a genuine transaction.
- Impersonate anyone, or misuse another person's documents or personal data.
- Harass, threaten, or discriminate against other users.
- Copy, scrape, or bulk-download listings or profiles, or interfere with Upland's security.
- Use Upland for anything unlawful.
8. Fees
Using Upland is currently free. We may introduce fees, for example for listing, verification, or obtaining an official search. We will publish any fee and tell you before it applies to you; no fee applies without that notice.
9. Suspension and closing your account
We may suspend or close an account that breaks these terms or puts others at risk, and we will tell you why unless the law or someone's safety prevents it. You can close your account at any time from your account settings; what happens to your data is explained in the Privacy Policy.
10. Our responsibility to you
We provide Upland with reasonable care and skill, but listings and profiles come from their authors, and we cannot promise the site will always be available or error-free. To the extent Kenyan law allows, we are not liable for losses arising from a transaction between users, from relying on a listing without independent due diligence, or for indirect or consequential loss. Nothing in these terms limits liability that cannot lawfully be limited, or your rights under the Consumer Protection Act.
11. Changes to these terms
We will publish any change as a new, dated version. When a new version takes effect we will ask you to accept it the next time you sign in; if you do not, you may close your account.
12. Law and disputes
These terms are governed by the laws of Kenya. Please contact us first so we can try to resolve any dispute; otherwise, the courts of Kenya have jurisdiction.
